1. Marketplace Responsibility
- Luxperiences serves as the marketplace connecting Members (Buyers) and Partners (Vendors).
- We facilitate secure transactions, holding all funds until Partners request payouts, ensuring accountability and trust.
- Refunds and cancellations are processed in accordance with the Partner’s cancellation policy as stated on their listing page at the time of booking.
- Luxperiences acts as an intermediary and is not liable for Partner errors or failure to deliver services, except in cases where negligence by Luxperiences is evident.
2. Credit Purchases
- Members can purchase Luxperiences Credits to use for booking experiences. Luxperiences Credits may be subject to promotional bonuses (e.g., $100 purchase earns $110 in Credits).
- Credits are non-refundable and expire 12 months from the date of purchase unless otherwise stated.
- Luxperiences Credits cannot be transferred to other Members or converted back into cash.
3. Refunds and Cancellations
- Each Partner sets their own cancellation policy, which is displayed on their listing page. Members are required to review and understand this policy before confirming a booking.
- Refunds may be issued in the form of Luxperiences Credits or returned to the original payment method, depending on the following circumstances:
- Refunds in Credits: Prioritized for flexibility and ease of rebooking, particularly for Member-initiated cancellations within the Partner’s stated policy.
- Refunds to Original Payment Method: Provided only if explicitly allowed by the Partner’s policy or as required by law.
- Refund requests must be submitted within 24 hours of the scheduled service or as stipulated in the Partner’s cancellation policy.
- Luxperiences reserves the right to mediate disputes between Members and Partners, with decisions made at our sole discretion based on the provided information.
- Partners are financially responsible for refunds caused by their failure to deliver services as described.
4. Member Responsibilities
- Members are responsible for ensuring the accuracy of booking details (e.g., dates, locations, preferences) at the time of purchase.
- Members must familiarize themselves with the Partner’s cancellation policy, available on the listing page, before confirming a booking.
- Any issues or disputes with the experience must be reported to Luxperiences within 24 hours of the scheduled event.
5. Partner (Vendor) Responsibilities
- Partners are required to clearly state their cancellation and refund policies on their listing page. These policies must comply with applicable laws and regulations.
- Partners must deliver services as described in their listings. Failure to do so may result in withheld payouts or additional liabilities.
- Partners agree to reimburse Luxperiences for refunds issued due to their non-performance, as determined by Luxperiences.
6. Liability
- Luxperiences is not liable for damages, injuries, or losses incurred during experiences unless explicitly caused by the negligence of Luxperiences.
- Partners are solely responsible for ensuring the safety, legality, and quality of their services.
- Members agree that Luxperiences’ liability is limited to the amount paid for the booking.
7. Payments via CrownPay
- All transactions are securely processed through CrownPay (powered by Stripe), ensuring industry-leading security and compliance.
- Members will see "CrownPay Luxperiences" on their billing statements for all transactions.
8. Privacy and Security
- Your personal information is processed securely and only shared with Partners to fulfill your booking.
- Luxperiences complies with all applicable data protection laws to safeguard your information.
9. Modifications
- Luxperiences reserves the right to modify these terms at any time. Updates will be communicated through our platform.
10. Acceptance
By proceeding with checkout, you confirm that you have read, understood, and agreed to these terms and conditions, including the Partner’s cancellation policy as stated on their listing page.
